How Postnuptial Agreements in California Echo the Harmony and Discord in Music

written by: on November 3, 2022

There are many things in this world that require practice and harmony to make it seem effortless when the time comes to make a decision but it is little known art that goes into crafting the right agreement after marriage. That is not to say that postnuptial agreements only apply to musicians, on the contrary these agreements apply to all couples but in this iconic grammar Nazi’s opinion, there are no couples that make as much magic, make as much mistakes, or know as much about a NOTEable agreement than musicians. It is the unions of two people with incomparable backgrounds, nervous habits, and senses of odd humor that sing songs passed down from their influences to the world for all to hear. It makes sense therefore to look at how music is crafted into an actual track when thinking about creating a postnuptial agreement. See, just as there are different instruments within a band, there are different stipulations within a postnuptial agreement, each with varying degrees of importance and contribution. Just like how different positions and structures play specific and crucial roles in a band, the same can be said for postnuptial agreements. With composing an album, the work that goes into it is endless; there is practice, writing, rewriting, airplay, the decision to tour or not tour, all put forth as effort and time exchange for an experience that both cohabitating parties hope will never end. While it may seem cruel to liken a marriage solely to some form of musical conception the misconception that an untimely dissolution will not hurt anymore if it was run like a business is equally cruel. The fact is that emotions run high and things are not always equal even in the best of well managed partnerships and where there are investments into projects that have no promise for a return, there must be an agreement up front if not to determine how the profits and losses of a venture are apportioned then to address how decisions are to be made that involve the special moments that have yet to happen in the future. Marriage, like music, is a personal statement and as artists, you want your work to be seen, heard and appreciated and in many cases, you want this even 30 years after its inception. No one expects that each album is going to be better than the last but you want to know that in between the gaps of poor sales and problematic contracts, you had the right people on board to help guide you along the way so that when you come out with that one hit wonder again, you can reestablish a sense of credibility. Just as it is important to have a record label, distributors, publicists, promoters, roadies, a manager, and a tour bus on hand for the ride, with a postnuptial agreement, it is imperative that a couple consults with an experienced family law attorney so that when this duo goes out on the road they can make sure that every show is a hit.
